A U.S. court of appeals on Oct. 3 granted Echostar Communications Corp.’s request to stay a permanent injunction aiming to bar the company from selling digital video recorders after it lost a patent infringement claim filed by Tivo in April.
“We are pleased the federal court found that Echostar has a ‘substantial case on the merits’ and blocked the Texas decision for the duration of the appeal… and we look forward to complete vindication of our position,” Echostar said in a release.
The company added “our customers will not be disrupted and all of our DVR models will continue to be available through the Echostar distribution system.”
