[Satellite Today 02-13-09] Boeing Co. has won the decision in an international arbitration case filed by a group of insurance underwriters in 2004, the company announced Feb. 12.
The underwriters were seeking as much as $365 million for defects on a satellite Boeing manufactured and sold to a Middle Eastern telecommunications provider.
Boeing said that an International Chamber of Commerce arbitration panel issued a final decision in January rejecting insurers’ claims regarding the 702-model satellite that experienced power problems in orbit. The satellite was used for video broadcasting and telecommunications.
Thuraya, the purchaser of the satellite, received a settlement from its insurers for the defective satellite.
The legal dispute was the first case in which insurers targeted a satellite maker to pay damages stemming from chronic satellite problems or defects.
